Maddison Peace Bain charged with manslaughter for allegedly causing fatal Furnissdale crash

A 25-year-old woman charged over a fatal hit-and-run in Mandurah had allegedly been drinking before the crash and left the victim to die on the side of the road. Kelly T’Hart was fatally struck on May 19 while she was walking along Riverside Drive in Furnissdale about 6pm. Emergency services attended the scene but could not save Ms T’Hart, who died from critical injuries sustained in the crash. Maddison Peace Bain, 25, was allegedly behind the wheel of the black Mazda 6 sedan that hit Ms T’Hart and has been charged with causing her death. She was not injured in the crash. Ms Bain faces charges of failing to stop and ensure assistance, failing to report the incident to police, driving a motor vehicle under the influence of alcohol and unlawfully killing another under such circumstances as not to constitute murder. She appeared in Mandurah Magistrates Court on Friday, where her charges were upgraded, with the latter two replacing previous charges of dangerous driving in circumstances which subsequently resulted in a death and exceeding 0.08g alcohol per 100ml of blood. During the court appearance, Magistrate Leanne Atkins read the new charges to Ms Bain, who spoke in a barely audible voice to confirm she understood them. Ms Bain, who was represented by a lawyer via audio link, was released on bail and will next appear in Mandurah Magistrates Court on October 8. Ms Atkins said the charges of failing to stop and ensure assistance, failing to report the incident to police and unlawful killing would be transferred to a higher court during that next hearing. It was the second court appearance on the charges for Ms Bain, who first appeared in Mandurah Magistrates Court on June 28. Ms T’Hart’s parents and family members attended the court appearance and were visibly upset after the hearing. Mother Susan T’Hart said outside court Ms T’Hart had turned 32 the day before the crash. She told the Mandurah Times her death was a “very tragic loss” and described her daughter as a beautiful person. Another family member said Ms T’Hart had the “most beautiful heart and soul”.
