Bill Shorten: Minister for NDIS says visibility the key to safety of National Disability Insurance Scheme

The idiom “out of sight, out of mind” has been in the vernacular for centuries and is as apt as ever today. It is a truism that I am sure many people with disability often feel applies to them. Unless you have lived experience, either personally or with a loved one, or work with people with disability, their challenges may be invisible. How Australians with disability go about their days is a foreign concept to many Australians who have never had close contact with their experience. That lack of understanding can see “people with disability” viewed as one big group. That is a wrong assumption. Like every one of us, people with disability are individuals with different needs and wants. I have been in Perth this week for a town hall to discuss the landmark NDIS review. One of the key issues that has been recommended in the review and raised by countless Australians with disability and the sector, is that the current system of regulation in the scheme is broken. Too many people are invisible or forgotten. Too many people are falling through the cracks. Disability advocate, participant and a panellist on the independent NDIS review, Dougie Herd, has spoken at previous town halls about his own life as a quadriplegic. Dougie needs support for his most basic and personal care. He explained that every single day of his life, a carer comes into his home to help him make his bowel work. He explained it is not only a routine done behind closed doors but is potentially life-threatening if done incorrectly. Dougie asked people to consider if they would want someone to perform such a personal, high-risk procedure for them or their family member if the worker was not qualified or if their background was not known. The NDIS review panel, people with disability and those in the sector said the current system does not give these assurances. The NDIS review recommended a new regulatory system be designed to help ensure everyone is safe on the NDIS and no one is invisible or forgotten. Under potential reforms, participants will still be able to choose who delivers their support, but many of the unregistered providers they use now would need to prove they meet a minimum standard to provide a service. I’m sure many Australians would be surprised that isn’t the case already. Some 160,000 unregistered providers today operate with little to no visibility of what they provide or if they deliver the services they charge for. If payments are not on the system, we can’t check that participants are safe or if they got what they paid for. Unregistered providers may offer flexibility, but there are currently not enough safeguards to ensure participants are protected from unethical or harmful practices. The NDIS review’s recommendation calls for greater oversight of those responsible for delivering services through the NDIS while continuing to promote choice and control for the participants who receive those supports. It recommended we have a level of regulation that matches the risk. For example, where a service requires minimal contact between the provider and the NDIS participant — gardening, for example — it would be considered low risk. Where people are providing more complex services, like the personal care Dougie receives, or are required to be in closed settings with participants, such as group homes, registration will require greater scrutiny. This is what the NDIS review calls a graduated risk regulation system. It’s like a sliding scale risk assessment. Low risk equals minimal regulation. High risk equals a requirement for more. This is what the independent review recommended. To assist the Government in designing the new system, a task force has been established. This task force is being led by trusted human rights lawyer and disability advocate Natalie Wade, former chair of the Australian Competition and Consumer Commission, Allan Fels, former ACTU assistant secretary and training and safety expert Michael Borowick, and former administrator in the Northern Territory, Vicki O’Halloran. The task force will look at ways to ensure all providers meet a minimum regulatory standard, especially those delivering more intensive support, while minimising the administrative impacts of the enrolment and registration process. The task force will provide a report with advice and recommendations to the Government in mid-2024. We want to reassure participants and their families this is not about removing choice and control but delivering quality and safety. And registration alone is not the silver bullet. There are registered providers who tick the boxes on audits but still deliver inconsistent quality or cut corners with unsafe practices. So, neither registered nor unregistered systems are working well. A whole system overhaul is the only answer. And I want to put this as simply as possible. I want the shonky providers out of my scheme. And I want them shaking in their boots about the consequences of their actions. Because let’s be clear about what is at stake here — the safety and well-being of NDIS participants. The Government is committed to working together with the disability community to respond to recommendations of the independent NDIS Review. The scheme has changed the lives of hundreds of thousands of Australians with disability, and we want it to change the lives of hundreds of thousands more in the future. But we have to fix its problems. I want to make sure every Australian who provides services to the NDIS is accountable. But, more importantly, every Australian who uses the NDIS is visible.
