Nick Bruining Q+A: Selling your investment property to a family member needing a hand is not so simple

Question I’ve recently retired and looking to simplify my affairs. While I was working, I was advised to purchase an investment property for $450,000, which has provided me with a boosted tax refund for the past few years. Unfortunately, the investment return hasn’t been that great and I still have a mortgage of about $400,000. Complicating matters further is that my daughter recently separated from her husband. As part of the settlement, she has received some money but is renting an apartment for herself and my grandson. I’m considering selling the investment property to her for an amount which simply clears my mortgage. The figures are roughly the same and this would help her out considerably. Are there any issues? Answer There are a number of matters that you need to be aware of surrounding tax and Centrelink. The sale of the property to your daughter will be regarded as a disposal and is regarded as a capital gains tax event. There are two components to the calculation, including the “cost-base” and the sale value. The cost-base will be your total original purchase price but this may be reduced if part of your tax strategy included depreciation. In this case, an adjustment will be made which will lower the cost-base and could effectively increase the profit. It seems likely the sale price to your daughter may be less than market value. When a transaction like this is not at “arm’s length”, authorities will want to ensure that full market values are used for their calculations. This requires you to obtain a formal valuation of the property at the time the transaction takes place. You will need to use a licensed valuer at your expense. You cannot use estimations provided by real estate agents. These valuations will be used by the Australian Taxation Office in calculating your capital gains tax liability. The WA Department of Finance will also use it in calculating your daughter’s stamp duty liability. You also need to consider the possible Centrelink implications if you plan on claiming an age pension in the near future, as you may be caught under the deprivation or “gifting” rules. In this case, the difference between the actual sale value to your daughter and the market value will be regarded as a deprivation. Under the rules, Centrelink will only reduce your assessable assets by $10,000 a year with a maximum of $30,000 over a rolling five-year period. For example, if the difference between the sale price and the market value is $50,000, $40,000 will remain in Centrelink’s systems for five years as a financial asset which may affect your pension under the income or the asset test.
